Rental Agreement

 

VACATION RENTAL AGREEMENT

YOUR WRITTEN OR PRINTED SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

 

Agency Disclosure

MOUNTAIN PAWS CABIN RENTALS, INC. serves as the agent and representative of all owners of vacation properties in its rental program, and is acting at all times, in and for the best interests of the owners.

 

Minimum Stay Requirements

 

 4 night minimum (July 4th, Thanksgiving and Christmas)

 3 night minimum (All Other Major Holidays)

 2 night minimum (All other times)

 

Minimum Age

You must be of legal and responsible age to rent our cabins. The person booking the cabin must be at least 25 years of age and be either the person or the spouse of the person whose name appears on the credit card. Parents please do not call to rent for college parties or for your children, as guests will be asked for proof of age at time of check-in.

All of our rental cabins are privately owned homes. These cabins are beautifully furnished and well kept and it is our goal to keep them this way.

 

Making a Reservation

To make a reservation, either call our office at 1-866-440-7297 or request your dates via our secure online booking tool.

PLEASE NOTE: For reservations made within 7 days of arrival, we require 100% pre-payment.

A down payment of $250 of the rental fee, by valid credit card, will secure your reservation and is charged to the card the day the reservation is made. We accept all major credit cards, however, there is an additional $2 processing fee to use an American Express credit card.

PLEASE NOTE: There is no reservation unless we have your credit card information.

The balance will be charged to the same credit card 7 days prior to your arrival. This is done because you will be going directly to your cabin and not to an office. For verification of your identity, we ask you to fax us a copy of your driver’s license. Guests are financially responsible for all damages and for additional cleaning fees if necessary. Should housekeeping find the house in an unacceptable condition, we will charge your credit card for damage repairs, replacement of missing contents, expenses resulting from agreement violations, such as phone calls, Internet charges, movie charges, trash left in unit, dirty dishes left unwashed, furniture moving, or unacceptable condition of unit on departure.

 

Peace of Mind Damage Waiver

In lieu of a normal damage deposit, there will be a $28 damage waiver fee per reservation. The damage waiver covers up to $250 in ACCIDENTAL and UNINTENTIONAL damages to the property and it’s contents. The Damage Waiver does NOT cover intentional or reckless damages, flea infestation caused by a pet, theft, excessive cleaning or accidental and unintentional damage over the coverage limit. The guest who uses their credit card for the down payment is considered the responsible party and authorizes Agent to charge guest’s credit card for the intentional or reckless damage, theft, excessive cleaning, flea infestation caused by pet and accidental and unintentional damages over the coverage limit no matter who in the group caused the damage.

 

Cancellations and Refunds

ALL CANCELLATIONS MUST BE MADE IN WRITING: E-MAIL, FAX or CERTIFIED MAIL. Our address is: Mountain Paws Cabin Rentals, P.O. Box 2532, Blue Ridge, GA 30513

 

For reservations cancelled more than 30 days prior to arrival, the full deposit will be returned minus a cancellation fee of $25 or 3% of any charges already made to your card, whichever is greater.

 

For reservations cancelled inside 30 days, 1/2 of the rental deposit ($125) is forfeited.

 

For reservations cancelled inside 14 days, the full rental deposit ($250) is forfeited.

 

For reservations cancelled 7 days (or less) prior to date of arrival, the guest is responsible for the amount of the entire cost of the booking, pending our ability to re-rent the cabin for the entire length of the anticipated stay. PLEASE NOTE: THIS POLICY INCLUDES LAST MINUTE BOOKINGS.

 

For your protection, Trip/Travel insurance is recommended. For travel protection insurance, we suggest CSA Travel Protection Insurance at 800-348-9505 or www.csatravelprotection.com or contact your local AAA Travel Agent for specific insurance plans available.

 

Changes to Reservations

Should you need to change your dates, we can reschedule your reservation with no penalty provided the change is processed at least 30 days prior to your scheduled check-in date. Your booking deposit will be placed in escrow for the future reservation. This policy does not include additions or subtractions to the number of guests.

 

Check-In/Check-Out Procedures

Check-in time is 3 PM. Check out time is by 10 AM unless you have pre-arranged a different time with management. Please be prompt, as a great deal of work must be done to prepare the cabin for the next guest’s arrival. Any delay could result in the cabin not being ready for them.

All of our cabins are privately owned and while we do not expect you to clean the cabin before you leave, we do ask that you leave it as you found it when you checked in.

·           Please clean all dirty dishes and return them to their proper place in the cabinets.

·           Pull the comforter back on all beds that have been used so that we are aware that the linens need to be cleaned.

·           If you use a sleeper sofa or futon, please strip the bedding, return the sleeper or futon to its normal sitting position and place the linens in the laundry area.

·           Leave all used towels and washcloths in their respective bathrooms. Please do not put wet towels on the wood floors.

·           Please remove all condiments and food items from the refrigerator, freezer and cabinets that you have brought with you. These items will be thrown away if left behind.

·           Please make sure that all of your garbage is tied up in garbage bags and placed in the garbage containers provided outside with the lid securely fastened. Do not leave garbage bags on the porches or decks as this will attract animals. Our garbage service will not pick up if there is loose garbage in the containers. Your failure to follow these instructions will result in an additional cleaning fee being charged.

·           If you have used the grill, please make sure that you have cleaned the grill and all utensils, turned off the propane bottle and that the grill cover is on.

·           Please return all game and puzzle pieces to their proper boxes. Put game and puzzles boxes back where you found them. This includes any videos, DVD’s and CD’s that you may have used.

·           Please make sure that the hot tub cover has been replaced and clipped down (if clips provided).

·           Please turn off all lights, TV’s, ceiling fans and other appliances.

·           Please set the thermostat to 60 degrees in the winter and 80 degrees in the summer.

·           Please lock all windows and doors.

·           Please leave the key on the kitchen counter and pull the locked door shut behind you.

 

Maximum Occupancy

Please adhere to the maximum occupancy number advertised for your cabin.

 

 

Smoking

There is no smoking allowed in any of our cabins. Smoking is allowed outside on the porches and decks. Please do not discard cigarette butts in the yard or surrounding areas, otherwise guest will be charged extra for picking them up. Smoking inside any cabin will result in additional charges billed to the guest for cleaning and fumigating the cabin.

 

Pets

We welcome guests with well-behaved, housebroken, pest-free pets. Please let us know in advance that you plan to bring your pets. Please make sure your pets have current vaccinations, are on a flea control program and have had their nails maintained. Since there are ticks in this area, you may want to check with your veterinarian to see if any additional vaccinations may be needed. Should damage to the cabin, furnishings or flea infestation occur, the Guest agrees to be responsible for all charges.

 

There is no leash law so plan accordingly. Unless your pet is in a fenced yard, please put them on a leash when outside. Please do not leave your pet unattended in the cabin unless they are crated.

 

Pets are not allowed in any hot tub. Guests agree to pay a cleaning fee of not less than $100 if their pet gets in the hot tub.

 

Please DO NOT give your pet a bath in any of the bathtubs. If we find evidence of this being done, you will be charged a $50 plumbing fee.

 

If your pet has an accident in the cabin, all clean up will be performed by the Guests. Guests agree to clean up after their pets in the yard and surrounding areas and deposit the waste into plastic bags that will be deposited in the outside garbage cans. . There will be an additional cleaning charge if we find that you have not cleaned up after your pet. Please leave these areas as clean for the next pet as it was for yours.

 

Pets are NOT ALLOWED to get on the furniture, on the beds or under the covers. Please do not put comforters, blankets, pillows, etc. on the floor where they can pick up pet hair.  Pet hair gets embedded in the material and you will be charged an additional cleaning fee if we find pet hair in the beds. A vacuum cleaner is provided in every cabin for those times when your pet is shedding. Please clean up after them if they are dropping a lot of hair.

 

We want your pet to have a great vacation too.

 

Homes, Furniture and Equipment

All of our cabins are privately owned property furnished and equipped by its Owner. As such, Agent(s) cannot make any changes to the furnishings or equipment provided by the owner. If Guest(s) requires special appliances or equipment, please bring them with you. Decor, style, and color will vary. Furnishings are subject to change without notice. Under no circumstances are furniture, bedding, mattress pads or any other property supplied with the cabin to be taken out or transferred from one cabin to another. This will result in a charge to the Guest(s). Moving of furniture is prohibited and any evidence of such will result in a charge against Guest(s) credit card. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the Guest(s), the renter. Certain areas in each rental property are locked for the OWNERS personal storage and are not included in this rental. While we make every attempt to provide comfortable and safe cabins, NO cabin is childproof.

 

Amenities

 Amenities are NOT guaranteed. There are NO REFUNDS for the malfunction of any equipment including but not limited to air conditioning, TV, hot tub, appliances, power outages and telephone service.  Every effort has been made to ensure all equipment is in working order.  Please report any inoperative equipment to management.  Owner, agent, housekeeping and /or subcontractors may enter premises during reasonable hours to perform maintenance. Please make sure that you inspect the cabin photos, description and amenities on the web site regarding the features, and condition of the cabin, as there is no refund of any portion of your rental fee upon arrival.

 

Early Departure

No refunds due to early departure. This includes departures due to inclement weather. All guests are financially responsible for the entire booking once your reservation has been made.

No refunds due to weather, road conditions, change of plans or not being able to find the cabin. During your winter visits, stay tuned to TV/Radio/Weather stations for storm warnings or watches. Nobody can ever predict the weather in the North Georgia Mountains and generally the months of January & February are when we may experience inclement weather. Most of the roads to the cabins are gravel with the exception of a few. It is recommended that you call ahead in January and February to see what weather and road conditions may be like. Depending on the severity of the storms and your location, it is your responsibility to take necessary precautions. We are not responsible for damages incurred due to weather or cost to evacuate your family or vehicles.

 

Hot Tubs

Hot tubs are cleaned after each rental and will be inspected after each rental. If any items such as food, alcohol, soaps or bath products, etc. are found in the hot tub, you will be charged an extra cleaning fee of $100. If we find evidence of pond, creek or river water, sand, grass etc. in the hot tub, you will be charged a cleaning fee of $100.

 

DO NOT sit, stand or walk on the hot tub cover. DO NOT remove the hot tub cover from the cover lift. Damage to any cover will result in a $300 charge.

 

HOT TUB INSTRUCTIONS AND WARNINGS:

NO Children unless closely supervised at all times by adults.

Please shower before using the spa.

NO Food – NO Glass – NO Suntan Oil/Cream - NO drugs or alcohol before or during the use of a spa to avoid unconsciousness and possible drowning.

Please do NOT wear street clothes in the hot tub as residual laundry soap in the clothing will create bubbles and foul the water prematurely.

People with infectious diseases should not use a spa or hot tub.

Persons suffering from heart disease, diabetes, high or low blood pressure, any condition requiring medical treatment, pregnant women, the elderly, or infants should consult with a physician before using a spa.

Do not use a spa or hot tub immediately following strenuous exercise.

Do not use spas or hot tubs unless all suction guards are installed to prevent body and hair entrapment.

NO electric appliances (e.g. light, telephone, radio, television, etc.) near the spa or hot tub.

Always test the spa water temperature before entering the spa.

Water temperature in excess of 38°C or 102°F may be injurious to your health.

Prolonged immersion in a spa or hot tub may be injurious to your health. It is UNSAFE to use your spa at temperatures above 104 degrees Fahrenheit or 40 Celsius!  It raises your core body temperature and can cause flu like symptoms.  It can also kill you!  Even at 104 degrees you should limit your time in the spa to no more than 15 minutes.  Some people shouldn`t use a spa that`s hotter than body temperature, 98.6 F / 37C.  Consult your doctor!

Enter and exit the spa slowly. Wet surfaces can be very slippery.

AFTER USE: Close all air valves and cover - Reset Temperature to 95F.

Covers must remain on the hot tub at all times when not in use.

 

Fireplaces and Fire Rings

Do not burn anything in gas fireplaces. These are self-contained units with NO vent or damper. It also creates soot on the logs and damages them. You will be charged a $150 damage fee if we find any evidence that paper, cardboard, etc. was burned in the fireplace. Campfires are only allowed at cabins with a fire ring. Do leave any fire unattended. Should any fire get out of control, the Guest(s) will be held responsible for all damage.

 

Emergencies

Call 911 for all medical or fire emergencies. In case of fire or house damage also contact the management after contacting 911. The closest hospital is Fannin Regional Hospital on Hwy. 5, Blue Ridge, GA.

Acts of God/Construction Noise

Neither Owner nor Agent(s) shall be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather and construction noise from nearby sites. NO REBATE OR REFUND will be offered in these circumstances.

 

General Statement

 All information contained herein is considered to be accurate and truthful. The homeowner, agent and housekeeping assume no responsibility and shall have no liability whatsoever for errors, including without limitations, typographical errors and or omissions. Rates, furnishings, and amenities are subject to change without notice. In the event a home is unavailable for rental due to fire, water damage, acts of nature, etc. we will do everything possible to find you equal accommodations. If we are not able to do this all deposits will be refunded. The Guest(s)fully understands that: the homeowner, agent and housekeeping is not responsible or liable to Guest(s) for loss or theft of any of the Guest`s personal property, accidents, injury or damage of any nature from any cause to Guest(s) (including licenses, or invitees) or acts of God, weather, road, travel or other recreational activities, or items removed or changed in the home.

Every effort is made to ensure all information in Agent/Owner’s advertising is accurate and complete.  However, Agent/Owner cannot be held responsible for typographical errors, omissions, price changes, and other changes made by owners within the unit.

 

Indemnification and Hold Harmless

 Guest(s) agree to indemnify and save harmless the Owner and Agent(s) for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The terms “Agent(s)” and “Owner” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms “Guest(s),” “You,” and “Your” as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be upon the rental property), where the context requires or permits.

Limitations of Remedies, Damages and Indemnity

If Agent/Owner is forced to resort to employment of legal counsel, litigation, or professional collection services in the collection of any amounts due Agent/Owner under this Agreement, Guest(s) shall be responsible for all costs of litigation and collection including, but not limited to, reasonable attorney’s fees if Agent/Owner prevails in said legal action.

 

Disputes

 This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as though it were executed in the County of Fannin, State of Georgia. Any action relating to this Agreement shall be instituted and prosecuted only in the Fannin County Superior Court, Georgia. Guest(s) specifically consent to such jurisdiction and to extraterritorial service of process.

Violating Agreement

 If Guest(s) violates any of the conditions of this Agreement; Agent(s) may terminate this Agreement and enter Premises. Upon notice of termination of this Agreement, Guest(s) shall vacate the Premises immediately and forfeit all rents and security deposits.

Right of Entry

 Guest(s) agree that the Agent(s) reserves the right to enter the rental property during reasonable hours to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements thereto as Agent(s) may deem appropriate, or to show property to prospective purchasers or guests.

 

Eviction

A material breach of this Agreement by Guest(s), which, in the sole determination of the Agent, results in damage to the Premises, personal injury to Guest(s) or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest(s) tenancy. Violation of any of the rules contained here in will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Cabins Act will apply. Guest(s) may be evicted under such procedures if Guest(s): (i) hold over in possession after Guest(s) tenancy has expired; (ii) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy; (iii) fail to pay rent as required by this Agreement, or (iv) have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in.
